These terms are the agreement between you and JKING HOLDINGS for using Boostly. They cover what the service does, what you are responsible for, how billing works, and what happens if something goes wrong. Please read them.
1Who We Are & What Boostly Does
Boostly is operated by JKING HOLDINGS, #2116, Building 1/7, Dunjingarav Street, Zaisan /17020/, 11th Khoroo, Khan-Uul District, Ulaanbaatar, Mongolia. These terms are an agreement between that company ("we", "us") and you — the person or business using Boostly.
Boostly lets you run Facebook and Instagram advertising from a single dashboard: building and publishing campaigns, promoting posts you have already published, creating and choosing audiences, pausing, resuming or adjusting ads after they launch, and seeing what your advertising achieved. It works through Meta’s official APIs.
By creating an account or using Boostly, you accept these terms and our Privacy Policy. If you do not accept them, do not use the service.
2Accounts & Eligibility
You must be at least 18 years old to use Boostly.
You are responsible for keeping your login details safe and for everything done through your account. Tell us promptly if you believe someone else has gained access.
The information you give us when registering must be accurate, and you must keep it up to date.
3Your Authority Over Connected Accounts
You must own, or hold administrator rights over, every Facebook Page, Instagram account, ad account and Business portfolio you connect to Boostly. If you act for a client, you confirm that they have authorised you to advertise on their behalf.
Boostly acts on your instructions. Ads created through the service are your ads, published under your Page and paid for from your ad account.
4Advertising, Budgets & Billing
Two separate sums of money are involved in using Boostly, and they never mix. Ad spend is charged by Meta directly to the payment method attached to your ad account. Boostly never receives, holds or forwards your advertising budget. Any dispute about ad spend, billing thresholds or refunds of ad spend is between you and Meta. The Boostly subscription fee is the other sum, and it is covered in the next section.
Your ad account is billed by Meta in US dollars. Boostly shows budgets and results in tugriks for convenience, converted at a fixed reference rate that is displayed alongside the US dollar amount wherever you commit money. Meta charges at its own exchange rate on the day of spend, so the tugrik figures in Boostly are an estimate and the US dollar amount is the authoritative one.
You are solely responsible for the content, targeting, budget and schedule of the ads you create. Your ads must comply with Meta’s Advertising Standards, Meta’s Platform Terms and the laws of Mongolia. Meta may reject, pause or remove any ad at its own discretion, and we cannot overrule that.
Reach and audience-size figures shown before you launch are estimates produced by Meta, not commitments. Actual delivery will differ.
5Subscriptions, Payment & Renewal
Boostly subscription fees are separate from ad spend and are billed in tugriks according to the plan you choose.
Payment is by invoice through QPay, not by card on file. When you subscribe we create a QPay invoice and show you a QR code and a list of bank links; you complete the payment inside your own banking app, where your bank authenticates you under its own controls. We store no card and hold no standing authority to charge you, so we cannot take money from you without you starting the payment yourself.
Because of that, nothing renews automatically. Your access runs until the expiry date shown in Settings and continues past it only if you pay for a further period. There is no subscription to cancel: if you want to stop, simply do not pay again, and access ends on that date. Everything you have already paid for is yours until then.
An e-receipt (и-баримт) is issued for each payment. Boostly is not registered for VAT, so the receipt carries no VAT breakdown. You choose at checkout whether it is a personal or a company receipt, and a company receipt needs the 7-digit tax register number at that moment, because a receipt is issued against one specific payment and cannot afterwards be reissued to somebody else.
Fees already paid are not refundable, except where a refund is required by the laws of Mongolia or where we have failed to provide the service you paid for. Where we do refund, note that a payment made by scanning a QR code in a banking app is not a card transaction and cannot be reversed through QPay: we return it by bank transfer and cancel the corresponding e-receipt.
We may change subscription prices. A new price applies to your next payment and never to a period you have already paid for, and we will tell you at least 30 days before it takes effect.
QPay is the payment provider, not a party to this agreement. It receives the amount, our invoice number and — only for a company e-receipt — the tax register number you enter, and it handles your card and bank details under its own terms, which you can read at qr.qpay.mn. Your card number, bank account number, PIN and banking password are never entered into Boostly and never reach us. What we hold and for how long is set out in our Privacy Policy.
6Acceptable Use
You agree not to use Boostly to send spam, run deceptive or misleading advertising, infringe anyone’s intellectual property, harass or discriminate against people, promote anything unlawful in Mongolia, or breach Meta’s Platform Terms or Advertising Standards.
You may not create ads that target people under 18. Boostly applies a minimum age of 18 to every ad regardless of the age range requested, and attempting to work around that is a breach of these terms.
You also agree not to attempt to access other users’ data, interfere with the service, circumvent rate limits, or use automated means to extract data from Boostly beyond what the product offers.
7Dependence on Meta
Boostly is built on APIs provided by Meta Platforms, Inc. Features may change, degrade or stop working if Meta changes its APIs, its policies, its rate limits, or the permissions granted to your account or to ours.
We are not responsible for decisions Meta makes about your account, your Pages or your ads — including rejection, restriction, suspension or the disabling of an ad account. Where we can help you understand or appeal such a decision, we will.
8Your Content
The ad images, ad videos and ad copy you upload or write in Boostly remain yours. We claim no ownership of them.
You give us permission to store, process and transmit that content to Meta for the sole purpose of building, previewing and publishing the ads you ask for. This permission ends when you delete the content or your account, except where a copy already sits inside your own Meta account.
You confirm that you hold the rights to everything you upload, including any images, music, trademarks or people’s likenesses it contains.
9Your Responsibility
You agree to cover our losses if a third party brings a claim against us because of your ads, your content, your use of Boostly in breach of these terms, or your lack of authority over an account you connected. This covers reasonable legal costs.
We will tell you promptly about any such claim and will not settle it without talking to you first.
10Disclaimer & Limitation of Liability
Boostly is provided as it is. We do not guarantee any particular advertising result — reach, engagement, sales or return on spend — and nothing in the product should be read as such a promise.
We do not guarantee that the service will be uninterrupted or error-free, though we work to keep it running.
To the fullest extent the law allows, our total liability to you for any claim is limited to the Boostly subscription fees you paid in the three months before the claim arose. We are not liable for lost profits, lost revenue, lost advertising spend, or indirect or consequential losses.
Nothing here limits liability that cannot be limited under the laws of Mongolia.
11Suspension & Termination
You may stop using Boostly and delete your account at any time, from the app or by writing to us.
We may suspend or close an account that breaches these terms, that is used unlawfully, or that puts our Meta API access at risk for other users. Except where the breach is serious or urgent, we will warn you first and give you a chance to put it right.
If we close your account without cause, we refund the unused part of any subscription you have paid for. Closing your Boostly account does not touch your Meta account, your Pages or ads already running.
12Events Outside Our Control
We are not liable for failure to provide the service because of events beyond our reasonable control — including outages at Meta or our infrastructure providers, loss of internet connectivity, natural disaster, war, or acts of government.
13Changes to These Terms
We may update these terms from time to time. We will announce material changes in the app or by email at least 14 days before they take effect, and update the date at the top of this page.
If you do not accept a change, cancel before it takes effect. Continuing to use Boostly after that date means you accept the updated terms.
14Governing Law & Disputes
These terms are governed by the laws of Mongolia.
If a dispute arises, please contact us first — most things are resolved faster that way. If we cannot settle it between us, the dispute will be heard by the competent courts of Ulaanbaatar, Mongolia.
15General
If any part of these terms is found unenforceable, the rest stays in force.
If we do not enforce a right straight away, we do not lose it.
You may not transfer your rights under these terms to someone else without our written agreement. We may transfer ours if our business is reorganised or sold, provided your rights are not reduced.
These terms and the Privacy Policy are the whole agreement between us about Boostly.
